In the law 10/2009 about representativity of the agrarian sector, that has just been published, two amendments to the law have been collected 45/2007 for sustainable rural development and law 19/1995 modernization of agricultural holdings in relation to the definitions of professional agriculture and professional farmer, respectively.

As a result, in the law for sustainable development, It means agriculture professional, the individual holder of an agricultural holding, livestock and forestry that requires a volume of employment to the least half unit of agricultural work and to obtain, at least, the 25% of their income from agricultural or complementary activities.

Also, the holder of an agricultural holding, livestock and forestry released in the special scheme for workers by account own Agrarians of the regime special workers for self-employed, as well as the enclosed in that scheme for agricultural activity.

As for the new definition of professional farmer in the law on the modernization of farms, It will be the physical person who being the holder of an agricultural holding, at least the 50% its total income to acquire the agricultural activities or other complementary activities, provided the part of income directly from agricultural activity is not inferior to the 25 per cent of their total income and employment engaged in agricultural or complementary activities is equal to or greater than half a working agricultural unit.
